UAE VAT Input Tax Recovery on Employee Expenses: FTA Decision No. 17 of 2026

UAE VAT Input Tax Recovery on Employee Expenses

The Federal Tax Authority (FTA) has issued Decision No. 17 of 2026, mentioning specific circumstances under which businesses can recover or deduct input VAT paid on certain goods and services provided to employees free of charge.

The Decision, which came into effect from 1 October 2026, will cover employee-related expenses such as travel, food and accommodation, mobile phones, internet services and parking fees.

This decision gives clarity for UAE businesses on when they can recover VAT incurred on employee expenses. However, businesses should maintain proper policies, supporting documents and evidence to prove that the expenses meet the requirements.

What is FTA Decision No. 17 of 2026?

Federal Tax Authority Decision No. 17 of 2026 mention the recovery of input tax incurred on employee expenses.

This decision applies when a taxable person purchases goods or services that are used by the employees free of charge, where there is:

  • A contractual obligation to provide the goods or services to employees or
  • A documented policy requiring the employer to provide them.

It is important to understand that the Decision does not mean all employee expenses incurred will automatically qualify for VAT recovery. Each category is aligned with conditions that must be satisfied.

When can businesses recover VAT on employee expenses?

The Decision contains six main categories where input VAT can be recovered or deducted, subject to conditions.

These are the following:

  1. Transportation of employees
  2. Food and beverages
  3. Employee accommodation
  4. Temporary accommodation for new employees
  5. Mobile phones, data packages
  6. Parking fees paid by employees

1. VAT on Employee Transportation

A business may recover input VAT on employee transportation expenses provided the required conditions are met.

The transportation service must be provided:

  • Between the place of residence and the workplace
  • To visit clients' premises
  • For another purpose which is directly connected with the execution of the employee's duties.

The transportation facilities should not be used for the employee's personal benefit.

Another major condition is that the employee should not have the option to receive a cash allowance or other financial compensation instead of this transportation.

Practical example

A company runs a staff bus for the transportation of employees from residential areas to the workplace. Then employees cannot avail a transportation allowance instead.

In this case, the VAT incurred on the qualifying transportation service may be recoverable, provided the other conditions are satisfied.

Businesses should maintain proper contracts, transportation arrangements and internal policies to justify the business purpose.

2. VAT on Food and Beverages Provided to Employees

VAT on food and beverages provided to employees can also be recoverable, provided specific conditions are met.

The place where the employee is living must be located in a remote, distant or isolated area.

In addition to this, there should not be enough facilities for preparing food in the employee's residence or workplace, and also there should not be nearby restaurants or facilities from which employees can easily get food and beverages.

The provision of food must also be directly connected with:

  • The work period of employees
  • The period during which the employee is required to stay at the residence because of the job requirements.

The employee must also not have the option to receive a cash allowance instead of the food and beverages.

Practical example

A company operates in a remote area where employees are required to be there during their work period. There are no adequate facilities for food preparation or no nearby restaurants.

If the employer provides meals to employees because of these working conditions, and the other conditions are satisfied, the related input VAT can qualify for recovery.

For claiming the above, the business should maintain evidence explaining why provision of food was necessary because of the location and working arrangements.

3. VAT on Accommodation Provided to Employees

Input VAT incurred on accommodation provided to employees may be recoverable where the accommodation is essential because of the operational requirements of the business.

The decision has some conditions to be satisfied.

There should not be an option for an employee to receive a cash allowance or financial compensation instead of accommodation.

The accommodation must be linked with the operational requirements of the work and should not simply form part of the employee's regular benefits or compensation.

The accommodation should be allowed only for the relevant employee and should not be provided for family members or other personal use.

The accommodation should also be necessary for the employee's job requirements and basic residential needs.

Why documentation is important

Accommodation expenses can be significant, so it is required for businesses to justify why the accommodation is required for regular operations.

Employment contracts, internal policies, worksite requirements and accommodation agreements can help to justify the business purpose.

4. Temporary Accommodation for New Employees

The Decision separately clarifies the conditions for input VAT recovery on accommodation given to new employees.

Below are the two conditions:

  • The accommodation must be temporary and provided for not more than 30 days.
  • The accommodation must be required for the employee's job conditions and basic residency needs.

Practical example

A UAE company recruits an employee from outside the country and provides temporary hotel or similar accommodation during the period of relocation and the joining process.

Where the accommodation is temporary for a period not exceeding 30 days and the other conditions are satisfied, the related input VAT may qualify for recovery.

Businesses should keep proper records showing the employee's joining date, accommodation period and relevant invoices.

5. VAT on Mobile Phones, Data and Internet for Employees

The Decision also covers the following:

  • Mobile phones
  • Airtime
  • Data packages
  • Internet packages from the employee's residence through a modem or router.

These expenses may qualify where the above are necessary for the employee to perform their job duties.

This includes situations where employees need to work beyond normal working hours or from outside the workplace, such as remote working or work-related travel.

However, the use must be limited to business purposes, or any personal use must be incidental and insignificant.

Internal policy is specifically important

The employer must have a documented internal policy mentioning the use of these goods and services.

The policy should clearly identify:

  • The usage
  • The scope of employee use
  • Consequences of unauthorised use.

6. VAT on Employee Parking Fees

Input VAT on parking fees may be recoverable where the parking expense is incurred only for business purposes.

The parking should be directly related to:

  • The employee's performance of job duties
  • Business visits
  • Related works.

Businesses must retain documents proving payment of the parking fees.

The supporting documents should have the following details

  • Date
  • Time
  • Amount paid
  • VAT paid

Practical example

An employee visits a client for a business meeting and pays for parking. The company's policy allows reimbursement of business parking expenses subject to approval and supporting documentation.

Where the conditions of the Decision are satisfied, the VAT included in the qualifying parking expense can also be recoverable.

Documentation and Internal Policies Will Become More Important

For certain employee expenses, the Decision specifically requires businesses to have internal policies or maintain supporting records.

Businesses should therefore review their existing policies, including:

  • Employee transportation
  • Meals and beverages
  • Employee accommodation
  • Temporary accommodation for new employees
  • Mobile phones and internet
  • Parking reimbursement
  • Employee expense claims

The policy should clearly explain the purpose of business, eligibility for claiming, approval process and any limitations on personal use.

Common Mistakes Businesses Should Avoid

Businesses should be careful about claiming entire input VAT on employee expenses simply because the expense was borne by the company.

Some common mistakes include:

Claiming VAT on personal employee benefits

An expense being paid by the employer does not automatically make it a business expense for VAT recovery purposes.

Providing cash alternatives

Several categories under the Decision specifically mention that employees do not have the option to receive a cash allowance instead of the relevant benefit.

Lack of documented policies

For mobile phones, internet services and parking expenses, documented internal policies are significantly important.

Insufficient supporting documents

Invoices, receipts, accommodation records, transportation arrangements and other supporting evidence should be retained.

Ignoring personal use

Where personal use is more than incidental or insignificant, it will affect the VAT recovery position.
